This Service and Usage Agreement ("Agreement") governs the use of the services provided by orionshost.com ("we," "us," or "our") to the customer ("Customer," "you," or "your") for web hosting, domain registration, dedicated servers, web development, and other related services ("Services"). By using or accessing the Services, you agree to be bound by this Agreement and all associated policies.

1. Services Provided

orionshost.com offers a range of services including, but not limited to:

  • Web Hosting: Shared hosting, VPS hosting, Cloud Hosting, and dedicated hosting solutions.
  • Domain Registration: Domain name registration, renewal, and management.
  • Dedicated Servers: High-performance dedicated server hosting, including management and customization options.
  • Web Development: Custom web development services, including website design, application development, and other related services.
  • Support Services: 24/7 customer support for troubleshooting and guidance related to hosting, domains, servers, and development.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials (such as your username and password) and for all activities that occur under your account. You agree to notify orionshost.com immediately of any unauthorized use of your account.

3. Acceptable Use Policy

You agree to use the Services in compliance with all applicable laws and regulations. You may not use the Services for illegal or harmful activities, including but not limited to:

  • Spamming, phishing, or sending unsolicited communications.
  • Hosting or transmitting harmful, offensive, or unlawful content.
  • Distributing malware, viruses, or other harmful software.
  • Engaging in any activity that negatively affects the performance or security of our services or the Internet.

orionshost.com reserves the right to suspend or terminate your account if you violate this policy.

4. Web Hosting, Domain Registration, and Dedicated Servers

  • Web Hosting: You agree to use our hosting services in accordance with the specific terms for your chosen plan. The service levels (including uptime, storage, and bandwidth) are outlined in the plan documentation. We reserve the right to modify or discontinue services at any time with prior notice.
  • Domain Registration: Domain registration is subject to the terms and conditions of the domain registrar. You are responsible for ensuring the accuracy of your domain information. Domains are non-transferable within a set period after registration, as defined by the registrar.
  • Dedicated Servers: You acknowledge that dedicated servers are subject to availability, and you are responsible for all data stored on the server. You agree to manage the server within the terms outlined in your plan, including any applicable resource limitations.

5. Web Development Services

  • Custom Development: You agree to provide accurate and complete information necessary for us to deliver web development services. The development process and scope will be outlined in a separate contract or agreement specific to the project.
  • Changes and Updates: Any changes or additions to the project scope may result in additional charges. You are responsible for reviewing and approving all deliverables.

6. Payment Terms

You agree to pay all fees associated with the Services as described in the pricing plan you select. Payments are due in advance for the Services provided. orionshost.com accepts the following payment methods:

  • Credit Card (Apple Pay)
  • Crypto (Only on Request)

Payments for services (such as hosting plans, domains, and dedicated servers) are processed securely via Stripe. You are responsible for providing accurate payment information and ensuring the payment is successfully completed.

  • Refund Policy: We offer a 15-day refund guarantee for most of our Services (including web hosting, domains, and dedicated servers). If you are not satisfied with our services, you may request a refund within 15 days of the initial purchase or renewal date. Refund requests submitted after this period will not be eligible for a refund.

    • Note: The refund guarantee does not apply to custom web development services, domain name registration (as domain fees are non-refundable), or services that have already been used or partially consumed.
    • Refund Process: To request a refund, you must contact our support team at support@orionshost.com within the 15-day period. Upon approval, the refund will be processed within 2 business days.

7. Late Payment, Suspension, and Termination

  • Late Payment: Invoices for services are due on the specified due date. If an invoice is not paid by the due date, we will send a reminder notice. If the invoice is not settled within 15 days from the original due date, orionshost.com reserves the right to suspend your website and services.

  • Suspension of Services: If payment is not received within 15 days after the invoice due date, we will suspend access to your website and related services. Suspension may include making the website inaccessible or halting web development and server activities. Your account will remain suspended until full payment is made.

    • Note: Suspension due to non-payment will result in the temporary halt of services. To restore a suspended account or receive a backup of a suspended account, a fee of $35 will be required, in addition to payment of the outstanding invoice.
  • Termination of Services: If payment is not received within 25 days from the original due date, we reserve the right to terminate your services entirely. Upon termination, all your data, content, and configurations will be permanently deleted, and you will lose access to your website and other associated services.

    • Note: Termination due to non-payment will result in the suspension of services. To restore your account, payment of the outstanding invoice plus a backup/restore fee of $35 will be required.

8. Service Availability and Uptime

While we strive to provide reliable services, orionshost.com does not guarantee uninterrupted service. We offer a 99.9% uptime guarantee, and any downtime or outages will be communicated to you promptly. We are not responsible for any damages or loss of data resulting from service interruptions.

9. Data Backup and Security

You are responsible for maintaining backups of your data. While we implement reasonable security measures to protect your data, orionshost.com cannot guarantee the security or integrity of your data. You agree to regularly back up all content hosted on our servers.

10. Termination of Services

  • By You: You may cancel your account or services at any time by submitting a cancellation request through our customer support channels. Please note that cancellation may not entitle you to a refund, depending on the terms of your plan.
  • By Us: orionshost.com may suspend or terminate your account or services if we believe you have violated any terms of this Agreement, including the Acceptable Use Policy. We will notify you prior to termination if possible.

11. Limitation of Liability

orionshost.com will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our liability will be limited to the amount paid by you for the services in question, as defined by your subscription or agreement.

12. Indemnification

You agree to indemnify and hold harmless orionshost.com, its affiliates, employees, and agents from any claims, losses, or damages, including legal fees, arising from your use of the services or violation of this Agreement.

13. Modifications to the Agreement

orionshost.com reserves the right to modify this Agreement at any time. Any changes will be posted on our website and will be effective immediately upon posting. It is your responsibility to review this Agreement regularly for updates.

14. Governing Law

This Agreement will be governed by and construed in accordance with the laws of USA, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located within USA.
